SSEN Have Today Issued Wayleave Notices to Landowners

SSEN have today issued notices on landowners affected by the TKUP new OHL requesting voluntarily wayleaves based on annual payments of £174 for smaller pylons and up to £608.76 for larger sizes.  Given the legal implications for those signing such a legally binding agreement it is surprising that SSEN have not recommended that those affected seek independent legal and valuation advice.

SSEN also appear to have omitted details of occupier and tenant payments from some packs.

SSEN seek return of signed agreements within 21 days.  If not accepted SSEN have to serve a further formal request on landowners and occupiers which, if not granted, will mean that the issue has to be heard by a Reporter who has to consider whether or not a wayleave should be granted.  Compensation, if not agreed, is then determined by The Scottish Lands Tribunal rather than based on the sums currently offered.

Those in receipt of such notices should seek advice from an experienced chartered surveyor before signing given the potential ramifications on agricultural businesses of SSEN’s current proposals.
